What The FCC: Neutered Net Neutrality: Boycott the Comcasket.
The battle continues as the FCC limps along like the eunuchs they are, and the Communications Industry continues to have the Courts in their pockets having them playfully work the balls as they prepare to screw the last remaining growth industry in American. What will Comcast do once they have NBC/Hulu?
This is a scary precedent to set as a major telecom provider can:
- Do whatever they want in controlling what you download how fast and when
- Not really have to answer for their actions to their customers or the FCC without mommy or daddy telling them they’re being dickheads and violating the nature of this whole thing we’re part of
- In the meantime make a play for the fastest growing TV alternative on the net
I’m not one of these let the government control everything kind of folks, but whats the point of federal commissions that need to argue with the context and purpose of the regulations they’re ENFORCING. This should not be a recommendation.
How about the Govt shuts down comcast or how about the Government actually funds an open committee for the creation of an transparent traffic measuring and throttling system based on international data exchange regulations determined by a global committee for these things? The internet isn’t ours.
Here are the excerpts which pisssedddd me off and what I find TOTALLY FUCKING MASTURBATORY on the part of the Federal Courts:
“Federal judges on Friday appeared unwilling to accept that the Federal Communications Commission has the authority it asserted in a 2008 citation against Comcast Corp. (CMCSA, CMCSK) for throttling Internet traffic from high-bandwidth file-sharing services.” (source: dow jones)
“unwilling to accept that the [FCC] has the authority it asserted”: I’m sorry…what? Federeallyreallyreally lame.
“You can’t get an unbridled, roving commission to go about doing good,” said U.S. Court of Appeals for the District of Columbia Circuit Chief Judge David Sentelle during an oral argument.” (source: dow jones)
Oh David Sentelle, we all know you have no interest in doing “good”. You’re out of context lackey who should be golfing on a beach somwhere and not making decisions about a future you will not be part of and are definitely not currently involved in.
Just who is David Sentelle?
Well, a simple search will reveal the following: David Sentelle voted to overturn the convictions of Oliver North.
OVERTURN THE CONVICTION of a man who ADMITTED his GUILT over illegally selling arms and funneling the profits to overturn a government.
What else has David Sentelle done?
Well, in 2007, he upheld the suspension of HABEAS CORPUS for enemy combatants, basically continuing the giant CIRCLE JERK that the bush administration began in declaring themselves king of all war time decisions and prisoner treatment. What happened to the Geneva Convention? (http://en.wikipedia.org/wiki/Geneva_convention)
Oh wait, he must be ‘unwilling to accept that authority’ that the ruling governments in the world had in determining humanitarian treatments during wartime.
Do we think that David Sentelle really understands torrent as a technology beyond bittorrent as an application?
“The three-judge panel grilled FCC General Counsel Austin Schlick on the parts of communications law it could cite to justify the Comcast punishment. The FCC argues that it was enforcing an open Internet policy implicit in the law. Judge A. Raymond Randolph [another meaningless figurehead] repeatedly said the legal provisions cited by the FCC were mere policy statements [????] that by themselves can’t justify the commission’s action. “You have yet to identify a specific statute,” he said. (source: dow jones)
Heres net neutrality in a nutshell:
“The Commission has jurisdiction necessary to ensure that providers of telecommunications for Internet access or Internet Protocol-enabled (IP-enabled) services are operated in a neutral manner. “ (source: fcc.gov)
What am I missing? Why is this even going to the courts?
OH the above document is basically just a Jerry Maguire style MEMO. Great.
Oh and the best part….
With ComCast going for NBC Uni (HuluHuluHulu) how will this play into their regulating internet usage of tv programming which is taking away from their advertiser driven tv data pipe wet dreams?
So far all I’m seeing is that Comcast has a hallpass Sentelle is more than happy to sign and the FCC has about as much real power on the internet as a substitute teacher.
Great news.
